Dyno Tuning Acknowledgement

Dyno tuning is an inherently high-risk process.

Tuning on a chassis dynamometer will push your vehicle to its mechanical limits. As the owner or authorized representative of the vehicle, you acknowledge that it is your responsibility to ensure the vehicle is mechanically sound and capable of safely handling the stresses associated with performance testing and calibration.

Origin83 LLC assumes every vehicle presented for testing has been properly maintained and prepared. Mechanical failures can occur before, during, or after dyno testing, even on well-maintained vehicles.

Origin83 LLC is not responsible for damage involving, but not limited to: engine failure, transmission failure, clutch failure, driveline failure, differential failure, axle failure, turbocharger failure, supercharger failure, fuel system failure, cooling system failure, electrical failure, tire failure, wheel failure, or aftermarket component failure.

Mechanical failures may result from pre-existing defects, component fatigue, improper installation, tuning limitations, or circumstances beyond the reasonable control of Origin83 LLC.

Liability Release, Waiver and Agreement

Nature of Dyno Testing

I have requested that Origin83 LLC test and calibrate my vehicle on the dynamometer. I understand that a dynamometer, commonly referred to as a dyno, is used to measure horsepower output. A chassis dynamometer uses large rollers upon which the drive wheels are placed. The vehicle may be operated under load and at speed so power delivered to the wheels can be measured or drivability issues can be diagnosed.

Assumption of Risk

I understand that dynamometer testing and performance tuning involve inherent risk. Testing for maximum horsepower places strain on a vehicle comparable to racetrack driving. Mechanical problems may occur during or as a result of testing and calibration, including but not limited to engine damage, engine failure, driveline damage, clutch failure, transmission failure, or damage to aftermarket components. I voluntarily assume these risks.

Release of Liability

I agree to release, indemnify, and hold harmless Origin83 LLC, its owners, agents, and employees from any and all liability, claims, or damages relating to diagnostic testing, dynamometer operation, or performance tuning performed on my vehicle, including claims arising from mechanical failure or vehicle damage.

No Warranty

I understand that Origin83 LLC offers no warranty of any kind, whether express or implied, regarding testing equipment, performance tuning, calibration results, horsepower output, drivability, reliability, or mechanical condition.

Shop Policies and Fees

If tuning cannot be completed for reasons outside the control of Origin83 LLC, I agree that I may be billed for time already spent and may be billed again when the vehicle is ready for additional testing or tuning. I understand dyno time and professional labor are costly and agree to charges for additional time, extra labor, or inconvenience fees when applicable. In the event of a fluid leak on the dyno, I understand there may be a cleanup fee of up to $350. I understand that no video or recording devices may be used without prior authorization.

Limitation of Liability

To the extent permitted by law, I agree that Origin83 LLC's total liability and my total recovery for any damage relating to or arising from testing or tuning is strictly limited to the total amount I paid for the testing. Origin83 LLC, its owners, agents, and employees shall not be liable for special, incidental, consequential, or punitive damages, including loss of use, lost profits, revenue loss, downtime, substitute transportation, inconvenience, or damage to other property.

Personal Injury

I understand that operation of diagnostic testing equipment and dynamometer equipment involves risk of personal injury. I assume all liability for accidental injury or bodily harm to myself or others and release Origin83 LLC, its owners, agents, and employees from any and all liability related to such injury.

Taxes and Equipment Responsibility

I agree to follow all instructions provided by Origin83 LLC. I shall be liable for damage to diagnostic or testing equipment caused by my use, actions, or failure to follow instructions. I understand that I may be responsible for any applicable sales or use tax imposed as a result of my use of testing equipment or services.

Customer Certifications
